TikTok has often found itself in the spotlight due to tensions between the US and China. Now, it appears that another major social media player is facing its own challenges. That’s right—Meta, the parent company of WhatsApp, Facebook, and Instagram, is set to confront an antitrust lawsuit in a US court.
The Federal Trade Commission has initiated legal action against Meta, alleging that the company has unfairly hindered the growth of competing social media platforms. This lawsuit could potentially compel the California-based firm to divest from Instagram and WhatsApp.
“Rather than outcompeting its rivals on the merits of its social networking offering (Facebook), Meta chose to protect its position through anti-competitive means,” reads the FTC’s pretrial brief, filed.
Mark Zuckerberg purchased Instagram in 2012 and WhatsApp in 2014, and these strategic acquisitions played a crucial role in establishing his vast social media empire. Today, Meta boasts billions of active users around the globe.
After many years, the US Federal Trade Commission is now scrutinizing these acquisitions in a significant antitrust case. The lawsuit argues that these deals were unlawful and should never have received approval, calling for a breakup of the company.
Such a separation would disrupt some of the most widely used digital products, reversing years of integration between Facebook and its apps, and raising important questions about how the government assesses and approves corporate mergers.
With a market capitalization of $1.3 trillion, Meta heavily relies on advertising revenue from Instagram. A breakup could wipe out hundreds of billions of dollars in market value.
Furthermore, with billions of users already engaged with these platforms, how will Meta navigate this potential crisis if it loses the lawsuit? The company has already intertwined its apps, allowing users to seamlessly switch between WhatsApp, Instagram, and Facebook. If the merger is dissolved, this integration would be lost. How will Meta maintain user experience without disrupting its services? These developments are likely to unfold soon.
Conversely, Meta remains quite hopeful about the current situation. In a statement, the company expressed its belief that the evidence will demonstrate that the acquisitions of Instagram and WhatsApp have positively impacted competition and benefited consumers. Additionally, Meta criticized the FTC for questioning these deals more than ten years after they were made.
“The Trump-Vance FTC is fully prepared for this trial,” stated FTC spokesperson Joe Simonson. “This agency is equipped with some of the most skilled and dedicated attorneys in the nation.”
This isn’t the only legal battle Meta is facing with the FTC. The agency is also alleging that Meta breached the terms of a 2019 privacy settlement, which involved a record $5 billion fine to address claims of violating a previous agreement related to data security practices. Furthermore, Meta is dealing with a related investor lawsuit in Delaware scheduled for later this summer.
It appears that Meta is navigating through numerous lawsuits this year. However, the most critical case revolves around the potential cancellation of the WhatsApp and Instagram acquisitions. The upcoming days are crucial for everyone involved. We’ll have to wait and see how this case unfolds.
